Retail mortgage lending - lending secured by a first or subsequent legal charge on residential property - is of great social and economic importance. Such lending underpinned the growth in home ownership in the post-war years and now additionally supports the buy-to-let market and a substantial amount of lending to businesses.

Over the past 40 years, the substantive law of mortgages has been supplemented by ever-expanding statutory and regulatory intervention in this area. Significant changes have recently been made to the regulatory regime by the replacement, on April 1, 2013, of the Financial Services Authority by the new "twin peaks" regulators, the Financial Conduct Authority and the Prudential Regulation Authority.
