Find an adviser terms and conditions

Terms and conditions for Find An Advisor:

1. The Member confirms that they are authorised and regulated by the Financial Services Authority (FSA) to give retail financial advice.

2. The Personal Finance Society (PFS) will provide inclusion within the findanadviser.org database and profiling on the findanadviser.org website determined by the user search (the "Services") to IFA members of the PFS qualified to advise in the areas they select (the "Member"), on a free of charge basis, provided that at all time the Member maintains an active email address and provides the PFS with any amendments to his data entry (including email and postal addresses, telephone number/s, and where applicable website addresses) within 7 days of the change.

3. The Member warrants that he will hold the PFS/CII harmless for all liabilities costs damages and expenses of whatsoever nature arising out him becoming a party to and supplying data under this Agreement.

4. The Member specifically warrants that the Member is solely responsible for any web site the Member operates and that where applicable, the Member is also the owner of any intellectual property relating to the web site or otherwise has been granted full rights over the intellectual property relating thereto. In such circumstances the Member fully indemnifies the PFS/CII against any claims and or actions arising in connection with the use of such intellectual property.

5. The Member acknowledges that the Services are provided on a free of charge basis and that as regards the Member and any entity for whom the Member is an employee or to whom he provides services, other than in respect of liability which cannot be excluded or limited by law, PFS/CII exclude all liability howsoever arising forany indirect or consequential loss or damage; loss of data or other equipment or property; economic loss or damage; incurring of liability for loss or damage of any nature whatsoever suffered by third parties (including in each case incidental and/or punitive damages); any loss of profit, interest, revenue, anticipated savings or business or damage to goodwill, even if CII is advised in advance of the possibility of any such losses and/or damages.

6. The Member warrants that the content of Paragraph 4 above has been expressly brought to the attention of and is agreed to by those who control the entity, whether described as directors, partners or in some other way.

7. Either party may terminate this Agreement: by at least one [1] month's notice; PFS may terminate this Agreement forthwith if the Member ceases to be a member of the PFS for any other reason whatsoever or in circumstances where the Member is or has been the respondent in any disciplinary action taken or contemplated by any regulatory authority, court, tribunal or a disciplinary panel of the CII (who administer the disciplinary procedures of the PFS).

8. Neither this Agreement nor any rights obtained under it shall be assignable by The Member. A person who is not party to this agreement shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement.

9. Any notice required to be given by either to the other party under this agreement shall be served personally or sent by first class pre-paid post or fax addressed to:

in the case of the Member, to the address supplied to the PFS for general correspondence and or by fax .

Where notice has been served by fax, the terminating party shall also confirm in writing and by Recorded or Special Delivery or such other method as requires a signature from the consignee on delivery, to the address noted above within 30 days.

Any notice sent by fax shall be deemed to have been received on the date of transmission and any notice sent by prepaid post within 3 days after the date of posting.

10. This agreement constitutes the entire agreement between the parties in connection with its subject matter and supersede all prior agreements, arrangements and understandings between the parties relating to its subject matter.

11. This agreement shall be governed by and construed in all respects in accordance with English law. The parties submit to the exclusive jurisdiction of the courts of England and Wales and agree that, in respect of proceedings in England and Wales and in any other jurisdiction, process may be served on either of them in the manner specified for notices in clause 8. Nothing in this clause 8 shall limit the right of CII or PFS to take proceedings against the Member in any other court of competent jurisdiction nor shall the taking of proceedings in any one or more jurisdiction preclude the taking of proceedings in any other jurisdiction, whether concurrently or not, to the extent permitted by the law of such other jurisdiction.

12.1 The Member acknowledges and agrees that he is entering this agreement as a practicing IFA in the course of his business or profession and for no other purpose.

12.2 The invalidity, illegality or unenforceability of any provision of this agreement or a provision in any other agreement which is identical to one in this agreement, shall not affect the other provisions and the agreement shall be given effect as if the invalid, illegal or unenforceable provision had been deleted.

12.3 The Member acknowledges that, such Member is entering into this agreement on the basis of its own enquiries and accepts that no representation is made by CII/PFS as to the development of the Members business.

13. Neither party shall be liable to the other or be deemed to be in breach of this agreement by reason of any delay in performing, or failure to perform, any of its obligations under this agreement if the delay or failure was beyond that party's reasonable control (including, without limitation, fire, flood, explosion, epidemic, riot, civil commotion, any strike, lockout or other industrial action, act of God, war or warlike hostilities or threat of war, terrorist activities, accidental or malicious damage, or any prohibition or restriction by any governments or other legal authority which affects this agreement and which is not in force on the date of this agreement).

14. These terms and conditions shall come into effect on 11 August 2008

15. PFS reserves the right to vary the terms of this agreement by one month's notice to the Member.
